These Terms of Service (“Terms”) govern your use of the Masqon website and any services sold or delivered by BURAK DEMIRBAS LLC under the MASQON brand (“Masqon,” “we,” “us,” or “our”). By accessing the website or purchasing services, you agree to these Terms.

Masqon provides a one-time done-for-you business implementation service. Unless explicitly stated otherwise in writing, Masqon is not a subscription SaaS product and does not provide ongoing service by default after delivery.
Masqon is offered to businesses and business representatives only. You represent that you are acting on behalf of a business or organization and that you have authority to bind that business or organization where applicable.
You must be at least 18 years old and legally capable of entering into a binding agreement. If you purchase or use the service for a company, you represent that you are authorized to do so.
The exact scope depends on the purchased package, the sales page, checkout details, written service description, and any additional written agreement between the parties.

Masqon’s stated delivery window is generally 48–72 hours after receiving all required access, credentials, materials, and information needed for the purchased setup.
This is an estimate, not an absolute guarantee. Delivery depends on client responsiveness, system condition, permissions, third-party platform compatibility, platform uptime, and actual implementation complexity.
You agree to:
After payment, Masqon uses a post-purchase Tally form to collect the information required to deliver the purchased service. Depending on the scope, this may include credentials, API tokens, access permissions, environment details, workflow preferences, or related setup inputs.
You are responsible for deciding what access to grant. Masqon will use such access only as reasonably necessary to deliver the purchased service.
All listed prices are in USD unless otherwise stated. Payment is due upfront unless a separate written arrangement applies.
Payment processing may be handled by third-party providers such as Stripe. Masqon is not responsible for third-party payment processor outages, restrictions, holds, or errors.
Refunds are governed by Masqon’s Refund Policy. Where the sales page states “working install or full refund,” that commitment applies subject to the conditions described in the Refund Policy.
Included post-delivery support windows are package-based:
After the included support window ends, any additional work, updates, maintenance, troubleshooting, modifications, or new channel additions may require a separate paid engagement or package upgrade.
Masqon may provide custom work outside the base package scope, but only where expressly agreed. Any such work may require a separate quote, paid add-on, upgraded package, or separate written agreement.
Client-requested updates after delivery, including new integrations, workflow changes, maintenance, reconfiguration, or platform-driven updates, are not included by default beyond the purchased package support window. Such work is offered separately for an additional fee where accepted by Masqon.
Masqon may rely on or integrate with third-party services, including but not limited to Stripe, Tally, Cloudflare, n8n, email providers, and other client-selected or infrastructure-related tools. Masqon is not responsible for downtime, outages, API changes, access restrictions, policy changes, or service failures caused by third-party providers.
Masqon does not guarantee reduced churn, increased revenue, better retention, or any specific business outcome. Any examples, demonstrations, sample outputs, or positioning language are illustrative unless explicitly committed in writing.
Delivery depends on client systems, permissions, and third-party compatibility. Masqon is not responsible for failures caused by incompatible environments, withheld access, broken third-party APIs, platform restrictions, or undisclosed technical limitations on the client side.
Unless otherwise agreed in writing, Masqon retains ownership of its pre-existing methods, frameworks, templates, implementation logic, documentation structures, and reusable know-how. The client receives the configured implementation and related deliverables included in the purchased scope, subject to any third-party licenses or platform restrictions.
You may not use Masqon’s website or services for unlawful purposes, abuse, fraud, infringement, malicious activity, or deceptive conduct. We may refuse or discontinue service where necessary to protect our business, legal position, or operational safety.
To the maximum extent permitted by law, the website and services are provided on an “as is” and “as available” basis, except where expressly stated otherwise in writing. Masqon disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Masqon will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost business, lost opportunity, lost data, interruption, or reputational harm.
To the maximum extent permitted by law, Masqon’s total aggregate liability for any claim arising from or related to the website or services will not exceed the total amount actually paid by the client to Masqon for the specific service giving rise to the claim.
You agree to indemnify and hold harmless Masqon, BURAK DEMIRBAS LLC, and its officers, contractors, affiliates, and representatives from claims, losses, liabilities, damages, and costs arising out of your systems, data, permissions, misuse of the service, breach of these Terms, or violation of law or third-party rights.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms, the website, or the services will be brought exclusively in the courts located in Sheridan, Wyoming, unless applicable law requires otherwise.
We may update these Terms from time to time by posting a revised version on this page with a new effective date.
